PostcodeSoftware.co.uk :: Terms and Conditions

This is a legal agreement between you and John Stepthen Consultancy Ltd t/a THESAURUS TECHNOLOGY ("THESAURUS TECHNOLOGY"). You are licensed by THESAURUS TECHNOLOGY to use its Postcode Software product ("Postcode Software") only on the terms set out below. Please read this agreement carefully:it contains important commercial and legal terms. Installing Postcode Software indicates that you accept these terms.

Single Copy Licence :: THESAURUS TECHNOLOGY grants you the right to use one copy of Postcode Software on a single computer, or such other number of copies as you may have purchased. Postcode Software is in use on a computer when it is loaded into the temporary memory (i.e. RAM) or installed into the permanent memory (e.g. hard disk CD ROM or other storage device) of that computer. If you require to use more than one copy of Postcode Software at a time then you must purchase the appropriate number of additional licences. If you have purchased additional licences then you may have as many copies of Postcode Software in use as you have licences. The number of persons using Postcode Software must not exceed the number of licences.

One Year Licence :: This licence has a duration of one year from the date of registration of Postcode Software. In order to activate Postcode Software, you must register Postcode Software with us by telephone as described in the installation procedure. Alternatively, where you have purchased Postcode Software over the Web, you will receive the necessary activation codes at the point of purchase. After one year Postcode Software will automatically cease to function. In order to reactivate Postcode Software you must purchase a further copy from us and register you details over the telephone, or, in the case of Postcode Software purchased over the Web, activate the new copy over the Web as described above. Postcode Software will prompt you to purchase a subsequent copy fourteen days before its expiry. The cost of renewal will be advised at that time and include an update to PAF.

Copying and Use :: You may make one copy of Postcode Software for backup purposes only. You must not sell or otherwise deal in Postcode Software, or alter or reverse compile Postcode Software.

Limited Warranty :: Where you have purchased Postcode Software on CD-Rom, THESAURUS TECHNOLOGY warrants that the disks upon which Postcode Software has been supplied are free from defects in material and workmanship in normal use for a period of 90 days from the date of purchase. In the case of any such defect, THESAURUS TECHNOLOGY will replace the defective disk(s) upon receipt of the same from you.

The software and data contained within Postcode Software are provided "as is" and THESAURUS TECHNOLOGY does not warrant the results of use of Postcode Software in terms of accuracy, reliability, current or otherwise. The liability of THESAURUS TECHNOLOGY is limited to the price paid by you for Postcode Software.

Entire Agreement :: This licence, which includes the Post Office Licence to follow, is the entire agreement between THESAURUS TECHNOLOGY and yourself and supersedes any prior agreement of communications between THESAURUS TECHNOLOGY and yourself prior to the purchase by you of Postcode Software.

Governing Law :: This agreement is governed by English Law and the parties submit to the jurisdiction of the English courts.

THE POST OFFICE END USER LICENCE

1. This Licence grants you the non-exclusive right to use extracts and derivatives from PAF, and Updates to PAF provided to you by THESAURUS TECHNOLOGY.

2. You shall not at any time reproduce, publish, sell, let, lend or otherwise part with possession of PAF or relay or disseminate PAF but you may make one back-up copy of each version of PAF for security purposes. You shall ensure that your employees, agents and sub-contractors comply with the terms of this Clause provided that nothing in this Clause shall prevent you from using PAF to modify existing mailing list databases.

3. You hereby acknowledge that the Post Office does not in any way warrant the accuracy or completeness of PAF and the Post Office shall not be liable for any loss or damage (whether direct or indirect or consequential) howsoever arising out of or in connection with this licence (or the Agreement of which it forms part) or its termination.

4. PAF and the copyright in PAF are and shall remain the property of the Post Office. This Licence shall not operate as an assignment of any copyright or any other intellectual property right that may subsist in PAF. You shall not remove or tamper with any copyright notice attached to PAF.

5. You must have a reasonable mechanism or process in place to ensure that the number of persons using the data does not exceed the number of licences purchased.

6. You are not entitled to assign, sub-licence or otherwise transfer any of your rights under this Agreement whether in whole or in part.

In this Licence the following expressions shall have the following meanings:

"Postcode Address File" a database which is owned by the Post Office containing all known addresses and Postcodes in the United Kingdom and "PAF", a registered trade mark of the Royal Mail (part of the Post Office), stands for Postcode Address File

"PAF" includes the Postcode Address File, Updates to the Postcode Address File and extracts from the Postcode Address File, Postzon, updates to Postzon and extracts from Postzon, PIF, updates to PIF and extracts from PIF, as supplied or contained in any product supplied by THESAURUS TECHNOLOGY

"PIF" the Postcode alone is not sufficient to identify each delivery point in the United Kingdom. A "Delivery Point Suffix" (DPS) has been developed: a two character code (one alpha, one numeric) which enables each delivery point to be uniquely identified. To enable customers to apply a barcode correctly to mail, both the Postcode and Delivery Point Suffix are required along with a Checksum Digit. The Checksum Digit can either be accessed via a small program which will generate it automatically, or from the file which contains the Delivery Point Suffix information. This file is referred to as the "Postcode Information File" (PIF)

"Postzon" is comprised of a version of PAF containing one record for each Postcode in the United Kingdom. The information supplied with each Postcode includes an Ordnance Survey Grid Reference and a variety of other coded identifiers which describe Country, County, District, Local Authority Electoral Ward and National Health Service District Health Authority
